These Terms of Service ("Terms") govern your access to and use of Battle of Races (the "Game"), operated by Turmina Labs ("we", "us", "our"). By creating an account or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.

1. Eligibility

Battle of Races is rated for ages 12 and older. If you are under the age of majority in your jurisdiction, you may only use the Game with the involvement of a parent or legal guardian.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate information when registering and keep it up to date.
• One account per player. Creating multiple accounts to gain an unfair advantage is prohibited.
• You may delete your account at any time — see how to delete your account.

3. Acceptable Use

When using the Game, you agree not to:

• Use bots, scripts, macros, or other automation to play on your behalf.
• Exploit bugs or unintended behavior instead of reporting them to us.
• Harass, threaten, or abuse other players.
• Buy, sell, or trade accounts, or transfer game progress outside the Game's own mechanics.
• Attempt to disrupt or gain unauthorized access to the Game's infrastructure.
• Use the Game for any unlawful purpose.

We may suspend or terminate accounts that violate these rules, at our discretion, with or without notice.

4. Third-Party Communities

The Game may link to third-party communities and services we do not operate — for example, a Discord server for alliance chat. Participation is optional and governed entirely by that service's own terms, privacy policy, and eligibility requirements, which may differ from ours. In particular, Discord requires users to be at least 13 years old, which may be older than the minimum age for the Game itself — you are responsible for meeting the age and other requirements of any third-party service you choose to use. We are not responsible for the availability, content, or conduct of other users on any third-party platform.

5. Virtual Currency and In-App Purchases

• The Game includes a virtual currency ("Shellins") and other virtual items that can be earned through play or purchased with real money through the Apple App Store or Google Play Store.
• Virtual currency and items have no real-world monetary value, are not redeemable for cash, and cannot be transferred between accounts or sold to other players.
• Purchases are billed and processed by Apple or Google under their own respective terms and refund policies — we do not directly process payments and cannot issue refunds ourselves. Refund requests must go through the App Store or Play Store.
• We may adjust the availability, pricing, or balance of virtual currency and items at any time as part of ongoing game development.

6. Game Availability and Changes

We may modify, suspend, or discontinue the Game or any part of it — including unit balance, game mechanics, and features — at any time. We may also perform maintenance that temporarily makes the Game unavailable. We are not liable for any loss of virtual currency, items, or progress resulting from such changes, except where required by applicable law.

7. Intellectual Property

The Game, including its name, artwork, code, and design, is owned by Turmina Labs and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to install and play the Game on your own devices for personal, non-commercial use. All rights not expressly granted are reserved.

8. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Game will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Turmina Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Game, including loss of progress, virtual currency, or items. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.

10. Termination

You may stop using the Game and delete your account at any time. We may suspend or terminate your access to the Game if you breach these Terms. Sections of these Terms that by their nature should survive termination (such as Intellectual Property and Limitation of Liability) will continue to apply.

11. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you inside the app and ask you to review and accept the updated Terms before continuing to play.
